GENERAL TERMS AND CONDITIONS
Parties
The Lessor is HAPPY3 GmbH with its registered office in Basel (hereinafter referred to as the Lessor). The Lessee is the respective natural or legal person registered in the rental contract who rents a vehicle from the Lessor.
Conclusion of Contract and Tariffs
The booking of the desired electric scooter made by the Hirer is a binding offer within the meaning of the Swiss Code of Obligations. The contract is concluded upon confirmation by the Lessor to the Lessee. This is subject to full payment of the rental fee for the entire rental period before the start of the rental period.
If the Hirer does not take over the vehicle at the agreed time, the reservation is not binding.
The tariffs are brought to the attention of the Lessee when the order is placed; they are available on the Internet at www.happyscooter.ch. By concluding the contract, the Lessee confirms that he has previously taken note of the tariffs applicable to the contract between him and the Lessor and of these General Terms and Conditions.
Obligations of the Hirer
It is forbidden to use the vehicle under the influence of alcohol or drugs. The Hirer undertakes to drive the vehicle carefully.
Hirers and additional drivers may only use the rental vehicle for the agreed purpose, in particular only for private use as a means of transportation for themselves. They are obliged to observe all traffic regulations.
For rentals, the minimum age of the tenant is 18 years.
Rebooking / Withdrawal
After conclusion of the contract, the renter may cancel the contract free of charge up to 24 hours before the agreed rental start time or make a rebooking free of charge. Cancellations made after this time will be charged at a 1-day rental rate. The withdrawal from the contract must be communicated to HAPPY3 GmbH by telephone or e-mail before the start of the rental period. A rebooking is only possible if the vehicle category requested by the renter is available.
Vehicle Handover / Rental Start
The renter is obliged to present a valid passport or identity card when taking over the vehicle.
Vehicles are handed over to the renter in a safe operating condition with a full battery.
Rental Price
The rental price is generally the rate agreed when the contract is concluded.
Terms of Payment
Payment is possible by bank transfer (prepayment) or a valid credit card. Cash payment is not possible.
Limited Liability of the Lessor
Any liability of the Rental Firm towards the Hirer and any additional drivers for any type of contractual and/or non-contractual personal injury and/or damage to property is expressly excluded.
Duty of Care and Notification of the Hirer
In the event of an accident, theft or other damage to the vehicle, the Hirer must notify the Rental Firm immediately and do everything necessary to mitigate the damage. In particular, in the event of an accident involving personal injury, he must immediately inform and involve the police. If the police refuse to record the accident, the Lessee must notify the Lessor immediately. The Hirer is prohibited from acknowledging or satisfying a claim in whole or in part, unless the Hirer's refusal to acknowledge or satisfy the claim would obviously be grossly unreasonable in the circumstances.
The lessee hereby authorizes the lessor to inspect police and/or official files in the event of a claim.
Liability and insurance
The Hirer is liable for all damage resulting from intentional or grossly negligent behavior.
If the vehicle is handed over to a third party (additional driver), the Hirer shall be liable for the third party's conduct as his own and shall be fully liable to the Rental Firm for any resulting damage.
The Hirer shall be liable to the Rental Firm and third parties without limitation for damage resulting from:
- willful or grossly negligent causation of damage
- careless handling of the vehicle and incorrect manipulation
- non-compliance with legal regulations (drunkenness, consumption of narcotics, etc.)
- Inadequate vehicle security (e.g. failure to lock the vehicle)
Return of the Vehicle
The renter undertakes to return the vehicle in accordance with the details set out in the rental agreement regarding the place, date and time of return.
The rental contract ends at the agreed time. With the agreement of the Rental Firm, the contract may be extended if the Hirer requests this before the end of the agreed rental period.
Personal Data of the Tenant
The tenant agrees to the storage of his personal data by the landlord in compliance with data protection regulations.
Applicable Law and Place of Jurisdiction
The rental agreement is governed exclusively by Swiss law.
The place of jurisdiction for all disputes between the Lessee and additional driver on the one hand and the Lessor on the other in connection with the rental relationship is Basel-Stadt.
